Hearing – To consider a 90-Day Variance from District Rule 206, Part 70 Permit to Operate 5840-R7, Part 2, Condition 9.C.2(a)(i) (and updates included in PTO 15876), submitted on July 24, 2026, for continued operation of the Petitioner’s Celpure 360 (Acid Demisting/Kiln Surge Bin) Scrubber in violation of the sulfur oxides (SOx) removal efficiency requirements while they troubleshoot the system, determine the cause of the failed source test, and implement corrective actions to reduce emissions and achieve compliance.
The Petitioner mines and processes diatomaceous earth at its Lompoc Plant, located at 2500 Miguelito Road, approximately one mile south of the City of Lompoc, California. The Celpure 360 (Acid Demisting/Kiln Surge Bin) Scrubber is used for SOx emissions control.
The Petitioner applied for an Interim Variance concurrently with the 90-Day Variance Petition. The Interim Variance was granted on July 30, 2026 and is in effect from July 24, 2026, through October 22, 2026, or the date a decision is made on this 90-Day Variance, or the date compliance is achieved, whichever occurs first. The 90-Day Variance, if granted, will allow the Petitioner enforcement relief from the date the decision is made on the 90-Day Variance, through October 22, 2026, or the date compliance is achieved, whichever occurs first.
