1) Case No. 14-07-N (90- Day) – ExxonMobil Production Company, P.O. Box 4358, Houston, TX 77210-4358
Hearing – To consider an application by ExxonMobil Production Company (Petitioner) for a 90- Day Variance from District Rule 206, Conditions 9.C.17 and 9.C.8.(b)(ii) of Part 70 Permit to Operate 5651. The Petitioner operates the equipment for which variance relief is being requested at their Las Flores Canyon gas processing plant located approximately 25 miles northwest of Santa Barbara, California. In conformance with their permit requirements, the Petitioner operates a sulfur dioxide analyzer to monitor emissions from their waste gas incinerator. Condition 9.C.17 requires this analyzer to pass a Relative Accuracy Test Audit (RATA) once each calendar year. On March 17, 2007 the annual RATA was conducted; however, following Petitioner’s review of the test results it was determined that the analyzer failed to meet required standards. The Petitioner immediately sought and was granted Emergency Variance Order 10-07-E, which remained in effect until April 20, 2006. During the emergency variance period the Petitioner determined the cause for the failed analyzer test was due to a failed heated sample line. This line is a custom made-to-order part and will take 4-6 weeks to acquire. The Petitioner applied for and was granted Interim Variance Order 13-07-I on April 20, 2007; providing relief from enforcement action for up to 90 days or until the Hearing Board could consider Petitioner’s request for a 90-Day variance, whichever occurred first. The granting of Petitioner’s 90-Day variance request will not result in the generation of excess pollutant emissions.
2) Case No. 12-07-MSa (Modification of Schedule) – County of Santa Barbara Public Works (County), NEO Tajiguas LLC (NEO), and MM Tajiguas Energy LLC (MM Tajiguas), Tajiguas Landfill, 14470 Calle Real, Goleta, CA 93117
Hearing – To consider an application by the County, NEO and MM Tajiguas (Petitioner) for a Modification to the Schedule of Increments of Progress contained in Variance Order 02-07-R which was heard and approved on March 7, 2007. Petitioner has stated the schedule is unreasonable, and they are unable to meet the compliance dates. This hearing will be for the modification of the compliance deadlines to select and install control equipment to reduce the concentration of sulfur compounds (specifically hydrogen sulfide, H2S) in landfill gas prior to combustion.

On March 23, 2007 Hearing Board member David Van Mullem, Jr. approved an Emergency Variance providing variance protection to the Petitioner from the requirements of District Rule 206 Condition 9.C.8(b)(ii) and 9.C.17 of Permit to Operate 5651 due to failure of the SO2 analyzer to meet the relative accuracy or applicable standard criteria for [email protected]%O2 (+/- 10%) at the Las Flores Canyon Oil and Gas Treating Facilities for the period of March 22, 2007 through April 20, 2007.
A-2) Case No.11-07-E – BreitBurn Energy Company 1515 Orcutt Hill Road, Orcutt, CA 93455
On April 2, 2007 Hearing Board Chair David Schmarje approved an Emergency Variance providing variance protection to the Petitioner from District Rule 325.D.1.a and Rule 206, Conditions 9.C.2 and 9.C.3 of Permit to Operate 8240 and 9.C.3 of Permit to Operate 11909 due to intermittent failures of the electric motor-driven vapor recovery compressor serving all of the crude, wash and wastewater tanks located at the Newlove lease for the period of April 3 through April 5, 2007.
A-3) Case No. 12-07-MS – County of Santa Barbara Public Works (County), NEO Tajiguas LLC (NEO), and MM Tajiguas Energy LLC (MM Tajiguas), Tajiguas Landfill, 14470 Calle Real, Goleta, CA 93117
On April 27, 2007 Hearing Board Chair David Schmarje heard a request to modify the schedule of increments of progress approved on March 7, 2007 as conditions of Regular Variance 02-07-R. As a result, the timeline of 02-07-R, Condition 1 was changed from April 30, 2007 to June 6, 2007 or the date of the next Hearing Board meeting. All other conditions remain in force until the date of the next Hearing Board meeting.
A-4) Case No. 13-07-I – ExxonMobil Production Company 12000 Calle Real, Goleta, CA 93117
On April 20, 2007 Hearing Board member Donald Ward approved an Interim Variance providing variance protection to the Petitioner from the requirements of District Rule 206 Condition 9.C.8(b)(ii) and 9.C.17 of Permit to Operate 5651 regarding operation of the Waste Gas Incinerator SO2 analyzer while correcting the RATA deficiency at the Las Flores Canyon Oil and Gas Treating Facilities for the period of April 20, 2007 through July 18, 2007, or the date of decision of the Hearing Board on the application for a 90-Day Variance (14-07-N), whichever occurs first.
